Excuse my ignorance here, but why is this important?
To not misinterpret an element from a foreign namespace which could be used for something completeley different. Assuming your XML vocabulary is not defined to be in a namespace, just add the && (node->ns == NULL) to the test, it just help keeping the X of XML (eXtensible).
